Court red-tape to be cut

Commission wants to remove ‘exequatur’ procedure.

The European Commission has proposed to eliminate a time-consuming procedure for the cross-border recognition and enforcement of judgments in civil and commercial matters known as ‘exequatur’.

The measure is part of draft revisions to a 2001 regulation that determines which court has jurisdiction in cross-border litigation adopted by the Commission on Tuesday (14 December).

Once the proposal has been backed by member states and MEPs, “legal decisions will be applied across the EU like domestic judgments”, Viviane Reding, the European commissioner for justice, said on Tuesday (14 December).

Business troubles

Reding told European Voice that she hoped the revisions would be adopted by the European Parliament and the Council of Ministers by the end of next year. She said that 40% of small and medium-sized enterprises consulted by the Commission had pointed to the exequatur procedure as the main reason why they did not do business across borders.
